W dniu 24 maja 2016 r. (wtorek), Elżbieta Łukacijewska, w imieniu polskiej Delegacji Grupy EPL w Parlamencie Europejskim, wspólnie z posłami: Dariuszem Rosati, Danutą Jazłowiecką, Januszem Lewandowskim i Różą Thun oraz prawie 60 innymi członkami European Parliament skierowała do Komisji Europejskiej pytanie dotyczące wprowadzenia przez Niemcy ustawy o płacy minimalnej.

Skierowana interpelacja jest kontynuacją wcześniej podejmowanych przez Poseł Łukacijewską działań w ramach pracy w Komisji Transportu w PE, na które składały się m.in. pisemne interpelacje oraz spotkania z przedstawicielami organizacji zrzeszających przewoźników transportowych i innymi interesariuszami. Elżbieta Łukacijewska liczy na szybkie rozwiązanie kwestii związanych z uruchomieniem przez KE procedury w sprawie naruszenia przez Niemcy Traktatu - EU Pilot.

"As of 01.01.2015 the German Minimum Wage Act (so-called 'MiLoG') establishing a minimum hourly rate of EUR 8,50 was applied also to all employees who only temporarily carry out their work on German territory or transit coach drivers, regardless of where their employers are permanently based. These provisions of MiLoG, in our understanding, make it impossible for transport undertakings to benefit from freedoms of the EU internal market.

In May 2015 the Commission stated that the application of minimum wage resulting from MiLoG was not justified as far as transit shipments and "certain international transport operations" are concerned, launching an infringement procedure against Germany.

However, the infringement procedure has lasted for over a year now, still not giving any detailed answers for companies, especially SMEs, on which rules are to be applied. This causes legal uncertainty and lack of clarity to further pursue economic activities within the EU.

Taking into account the above and the Commission's answer to the written questions E-010081/14, E-010749/14 and P-010809/14 of various MEPs, we are asking the Commission to reply to the following questions:

1. Has the Commission already received precise clarification and satisfactory justification from the German government on MiLoG and its compliance with the EU law?

2. What is the current stage of the infringement procedure on this issue?

3. Does the Commission plan to address this issue in its upcoming Road Package? Especially, taking into account that the legal uncertainty created may cause further internal market distortions, with other Member States introducing similiar actions".
